Super Kanji Search : End-User License Agreement(EULA)

[Notice]: This Agreement in English is provided for reference purpose only. The original and effective license agreement is written in Japanese.

Use of "Super Kanji Search"(Windows version/Linux version) shall be permitted only on condition that the User agrees to abide by the terms of use below. By installing the Software, for any reason, the User is considered to have indicated agreement with this EULA.

"Super Kanji Search"(Windows version) uses GTK+(The GIMP Toolkit), and the package of GTK+ runtime environment is included in this software product. "Super Kanji Search" described below means that GTK+ is not included. Regarding the terms of use for GTK+, please refer to the License Agreement displayed when GTK+ runtime environment is installed.

Article 1. (Permitted Uses and Intellectual Property)

  1. The User shall be granted a non-exclusive right to use the software "Super Kanji Search"(hereinafter "the Software") provided by Personal Media Corporation(hereinafter "PMC") under the conditions listed in either (a) or (b) below.
    • (a) If any one of the Windows version or the Linux version is installed on the single PC, multiple persons shall use the installed Software on the single PC.
    • (b) If the User of the Software is limited to yourself and only one person, the User shall install and use both the Windows version and the Linux version on multiple PCs for the User's use only, on condition that you shall not use the Software simultaneously.
  2. Even before making a purchase decision, the User shall be granted a right to use the Software for evaluation within a period specified by PMC. The provisions in this EULA shall be effective, whether before or after purchasing the Software.
  3. If the supplied medium for the Software is the physical medium(e.g.CD-ROM), the User shall be permitted to possess the physical medium. But, the intellectual property in the Software belongs to PMC or to the suppliers of software to PMC, regardless of the type of the supplied medium.

Article 2. (Prohibited Matters)

  1. The User shall not, without the express written consent of PMC, duplicate or modify the Software. This prohibition does not apply to duplication for the purpose of backup or installing the Software. In such cases the User shall have the same obligation of copyright display for the duplicated software as for the original copy.
  2. Except as set forth in Article 1.1(a) of this EULA, the User shall not have another person, any third party or parties use the Software or the copies of the Software(including the modified Software), regardless of the whole or part of the Software, without PMC’s written consent. Also the User shall not transfer or resell the Software and shall not use the Software for rental or lease business.

Article 3. ( Specification Changes and Maintenance )

  1. PMC may, without prior consent or prior notice to the User, change the specification of the Software.
  2. If the operation of the Software does not conform to the accompanying documentation, PMC shall endeavor to make repairs, for at least one year from the date of purchase, in the case of users who have purchased the Software.

Article 4.(Warranty and Limitation of Liability)

  1. If the supplied medium for the Software is the physical medium, PMC warrants that the physical medium in which the Software is supplied shall be free of defects for a period of 60 days from the date of purchase. If a defect is discovered in the physical medium in which the Software is supplied, the User may obtain a replacement copy by returning the defective item to PMC along with proof of purchase.
  2. PMC makes no warranty as to whether the functions of the Software meet the User's needs, and does not warrant that the Software will operate without interruption or that the result of its operation will be error-free.
  3. PMC shall not be liable for any direct or indirect damages arising from the use of the Software or for payment of compensation, except as otherwise required in national or local legal statutes.

Article 5.(General Provisions)

  1. The provisions in this EULA do not affect or prejudice the statutory rights of a consumer by consumer protection laws.
  2. The provisions in this EULA shall be governed by the laws of Japan.
  3. If any provision of this EULA shall be held by a court of competent jurisdiction to be contrary to law, the remaining provisions of this EULA will remain in full force and effect.
  4. In disputes between the User and PMC regarding the provisions in this EULA, the Tokyo District Court in Tokyo, Japan shall have jurisdiction as the court of first instance.
